Each economic sector benefits from competition. However, sometimes there are unfair competitors and even former business partners can be unfair. Their actions might contradict the legislation of Ukraine while the decisions of antitrust bodies may be groundless. Of course, this greatly impedes any business to flourish and develop. Laws oblige entrepreneurs to obtain the conclusion or permission of the Antimonopoly Committee of Ukraine at the stage of firms or legal entities creation. In general, competition policy and the whole concept of economics changed for the better in 2002 when the law of Ukraine “On Protection of Economic Competition” came into force. That’s why the laws of Ukraine “On Restriction of Monopolism and Prevention of Unfair Competition in Business” and “On Antimonopoly Committee of Ukraine” were adopted. These legal acts created the first serious prerequisites for the establishment of the competition law in our country. They were formulated in Article 42 of the Constitution of Ukraine which enshrined the state guarantees for protection in the legal field.
