More about the service
Who needs a lawyer to address issues in the field of migration law? In fact, everyone who has decided to find a job or move to another country, in our case to Ukraine.
Migration law is regulated not only by national legislation, but also by international law. Consequently, this branch of law implies interaction with legislative bases of other countries, solution of disputable issues, and execution of documents in different languages. Therefore, it is always better to turn to experienced professionals specializing in migration issues. They will advise and help you to understand complex procedures of migration legislation. Lawyers of the Epravo company have a proven record of successful cases in this domain.
Migration law regulates internal movement of people on the territory of any country. Our specialists know all the intricacies of migration law, thus we can effectively and quickly help you to solve these questions. We provide services related to:
– application for a temporary or permanent residence permit;
– application for citizenship;
– extension of stay of a non-resident in Ukraine;
– business registration;
– appealing against the migration service decisions;
– issuance of a taxpayer card;
– work permit;
– issuance of summons/invitations;
– visa applications for traveling abroad;
– preparing documents for employment abroad.
Support of a lawyer is crucial not only when you have to deal with the standard procedures. It is also very important that a migration specialist accompanies you in disputes with migration authorities. This way, you will have higher chances that a case turns out in your favor. You will be spared the need to go through bureaucratic time-consuming procedures, prepare documents, and visit state agencies. This really does take a lot of effort and time, especially since there are legal traps, loopholes, and niches everywhere. You cannot get around or use them for your benefit if you do not have enough experience in dealing with migration issues.
One of the most complex and demanded procedures related to migration is application for a residence permit. However, we can help you with this question.
A residence permit in Ukraine can be either temporary or permanent. The only difference between these two documents is their validity period. Permanent residence permit is valid indefinitely and is issued for a lifetime. The temporary one is valid for a year but it might be extended. You can get a temporary residence permit from the age of sixteen. Why do foreigners need a residence permit? What benefits does it give?
The thing is that citizens of countries with visa-free entry may not stay in Ukraine more than 90 days, but within 180 days. If a person plans to do business or work in Ukraine, 90 days is not enough. That is why the decision to apply for a residence permit may be the only right one in many cases. A foreigner gets the right to legally stay in Ukraine, to conduct full-scale labor and economic activities, to become a bank client, and to get education.
However, the issuance of a temporary residence permit is often inconvenient because of the concept of “tax residency”. This means that if there is additional income outside the territory of Ukraine, the foreigner faces additional checks and embezzlement. In such cases, permanent residence may be a more convenient prospect. What are its advantages?
The main thing is that a foreigner has the same rights as a Ukrainian citizen. The exceptions are defined by separate legislative acts of Ukraine.
In order to apply for a residence permit in Ukraine, you would need the following documents:
– passport;
– 8 matte 35×45 photos;
– documents for property in Ukraine (if any).
The documents mentioned on this list are not always sufficient. Often people need to prepare additional documents after consultation with our lawyer. For example, people who are married to a citizen of Ukraine for over two years will also need a marriage certificate. Citizens who have blood relatives or want to become a guardian of one of them will need proof of blood ties. In brief, it is very important to consider the specifics of any situation and to prepare all possible additional documents that may help in the case of application for a residence permit.
There are some peculiarities in the registration of employment for a foreigner. These documents are drawn up by an employer and are valid for 6 months to 3 years with the possibility of extension. The employer here can be both a natural person and a legal entity. In this case, the number of positions occupied by a foreigner is not limited. However, it is important to understand that each of the positions must be accompanied with a mandatory permit. Obtaining a tax number is also obligatory. Our competent lawyers are always ready to help you in this issue and fully engage in legal support of obtaining a work permit for a foreigner in Ukraine. We will help you to prepare the documents according to all legal requirements for the procedure to be successful and as fast as possible.
